Correct me if I'm wrong but I think SWAbooru currently is using the default Danbooru legal terms (https://swaggerswithattitude.com/privacy, https://swaggerswithattitude.com/terms_of_service, and https://swaggerswithattitude.com/2257) which should be reviewed and updated to better reflect the actual site's policies.
